(Map Data)

This Terms of Use (“Terms of Use”), constituting a part of the terms and conditions of using the website (this “Website”), governs your use of map data available in this Website (the "Data") and forms a valid and binding contract between you and Minamikyushu City . Please make sure to read this Terms of Use before using the Data. Once you access or start to use the Data, you shall be deemed to have agreed to this Terms of Use.

Article 1 (Ownership of Data and License Grant)
1.1 You acknowledge and agree that Zenrin Co., Ltd. and any of its licensor owns the copyright in and to the Data.
1.2 You are granted the following use rights with regard to the Data to the extent permitted as the “private use” under the copyright law of Japan and no other right or license will be granted to you under this Terms of Use:
(i)to browse the Data displayed on the Website; and
(ii)to print out any portion of the Data displayed on the Website on a paper.

Article 2 (Restriction on use)
In using the Data, you shall comply with the following terms and conditions:
(i)Unless expressly permitted in Article1, you shall not copy, print, transfer, extract, modify, update, adapt, send, or otherwise use the Data in whole or in part.
(ii)You shall not distribute, share, sublicense, transfer, assign, rent, sell, make publicly available, or otherwise permit any third party to access or use the Data (including any copies, abstractions, modifications or derivatives thereof), whether with or without consideration.

Article 3 (DISCLAIMERS)
THE DATA SHALL BE PROVIDED AS IS, WITHOUT EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, INCLUDING ANY WARRANTY OF TITLE, ACCURACY, OR OF NON-INFRINGEMENT. Minamikyushu City DOES NOT WARRANT THAT THE DATA WILL FUNCTION UNINTERRUPTED OR ERROR FREE, NOR DOES IT MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE DATA. IN NO EVENT WILL Minamikyushu City BE LIABLE TO YOU FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR RELATING TO THIS AGREEMENT, WHETHER DIRECT OR INDIRECT, INCLUDING, BUT NOT LIMITED TO, LOST REVENUE OR PROFIT, AND SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY. YOU ASSUME TOTAL RESPONSIBILITY FOR YOUR USE OF THE DATA .

Article 4 (Modification,Suspension or Discontinuance of Website)
4.1 For maintainance and inspection of this Website on a regular basis, Minamikyushu City reseves the right to temporarily suspend provisions of all or any portion of the Data on this Website.
4.2 In any of the following cases, Minamikyushu City reseves the right to temporarily suspend provisions of all or any portion of the Data on this Website without a prior notice to you:
(i)When conducting emergency maintenance or inspection of this Website;
(ii)When operation of this Website becomes impossible due to an accident such as fire or blackouts, natural disasters such as earthquakes or floods, war, riots, labor disputes,or any other cause beyond control;
(iii)When Minamikyushu City decides that temporary interruption of this Website is necessary due to unavoidable operational or technical circumstances; or
(iv)When the operation of this Website becomes impossible due to defects or errors of this Website.
4.3 Minamikyushu City reseves the right to cease operation and provision of this Website at any time at Minamikyushu City ’s sole discretion.

Article 5 (General Terms)
This Terms of Use shall be governed by and construed in accordance with the laws of Japan, but without reference to its conflict of laws principles.

Article 6 (Language)
This Terms of Use shall be prepared and executed in both in Japanese and English languages. If there is any discrepancy or inconsistency between Japanese and English version, the Japanese version shall prevail.

＜Information Regarding Sediment Disasters＞
1 Sediment Disaster Warning Areas(yellow zone) and Sediment Disaster Special Warning Areas(red zone) are based on the "Promotion of Sediment Disaster Prevention Measures Regarding Sediment Disaster Warning Areas Law", and is an area designated by Kagoshima Prefecture where there is a risk of harm to residents in the event of the collapse of a cliff or a debris flow.
2 The Mountain Disaster Hazard Area is shown based on the results of a survey carried out by Kagoshima Prefecture on areas thet are likely to cause direct damage to public facilities and houses such as goverment offices,schools,hospitals,and roads due to the collapse of mountainous areas,landslides,and spills of sediment failure.

＜Information Regarding Floods＞
The potenitial flooding Areas are shows the potenitial flooding area and the potenitial depth of water in case of flooding due to the maximum possible rainfall,which is designated in accordance with Flood Prevention Law for the flood forecast section of the Manose River water system.The simulation predicts the inundation situation when the Manose River overflows due to flooding caused by the maximum possible rainfall,taking into account the status of the river channel and flood control facilities of the Manose River at the time of designation.
In simulation does not take into account inundation due to the collapse of tributaries,inundation of a magnitude exceeding the rainfall assumed in the simulation,storm surge,or inland flooding.
Therefore,flooding may occur in areas that are not designated as flood inundation areas,or the assumed depth of water may differ from the actual depth of inundation.

＜Information about Tsunamis＞
The area that is expected to be flooded by the L2 tsunami is based on the tsunami inundation forecast map of the Kagoshima Prefecture Earthquake and Other Disaster Damage Prediction Survey released by the Crisis Management Bureau in March 2013.
The area expected to be flooded by the L2 tsunami is the largest-class tsunami that can be considered at this time,with Kagoshima Prefecture's own consideration being added to two cases of the estimated huge earthquake in tha Nankai Trough announced by the government that have a large impact on Kagoshima Prefecture.
The L2 tsunami inundation zone shows the inundation area,which is expected to be flooded in the event of a maximum class tsunami under bad conditions,and the depth of inundation,which is the largest depth of water at each point in the inundation area,and the inundation area and depth of the tsunami are not the first of the tsunamis,but the largest after the second.

＜Information about Reservoir＞
The information on reservoirs is based on the hazard map of reservoirs prepared by Minamikyushu City,which shows how far the flooding area would spread if a reservoir were to collapse.
Keep in mind that in the event of an actual disaster,there may be more than expected.

＜地図利用規約＞
本サイトにより提供される地図データ（「データ」）のご利用前に、以下の規約を必ずお読み下さい。以下の規約は、本サイトの利用者（「利用者」）と南九州市とのデータの利用に関する契約の条件となります。本規約すべてにご同意いただけた場合のみデータをご利用下さい。データを利用された場合は本規約にご同意いただいたものとします。

第１条（データの著作権及び使用許諾）
１．データの著作権は株式会社ゼンリン又はこれに権利を許諾する第三者に帰属します。
２．南九州市は、利用者に対して、著作権法に定める私的使用の範囲内で、データについて以下の権利を許諾します。なお、利用者はデータについて、これら以外のいかなる権利も取得するものではありません。
(1)本サイト上で表示されたデータをWebブラウザで閲覧すること。
(2)本サイト上で表示されたデータを紙媒体に印刷出力すること（本号に基づき印刷出力したデータを以下「複製成果」という）。

第２条（遵守事項）
利用者は以下の事項を遵守するものとします。
(1)前条で明示的に許諾される場合を除き、方法の如何を問わず、データの全部又は一部を複製（印刷を含む。）、転記、抽出、加工、改変、翻案、送信その他の利用をしないこと。
(2)有償・無償を問わず、また、譲渡、使用許諾、送信その他方法の如何を問わず、データ（その全部又は一部の複製物、出力物、抽出物その他利用物を含む）を第三者に利用させないこと。

第３条（保　証）
利用者は、データは必ずしも利用者の使用目的又は要求を満たすものではなくまたすべてが正確かつ完全ではないこと及び南九州市はこれらがあってもデータの交換・修補・代金返還その他の責任を負わないことを了承するものとします。

第４条（本サイトの停止等）
１．南九州市は定期的に本サイトの保守・点検を行う際、一時的に本サービスの全部又は一部を中断することができるものとします。
２．南九州市は次の各号の何れかに該当する場合は、利用者に事前の通知をすることなく一時的に本サイト運営の全部又は一部を中断することができるものとします。
(1)本サイトの保守・点検を緊急に行う場合。
(2)火災・停電等の事故、地震・洪水等の天災、戦争、暴動、労働争議等により、本サイトの運営が不可能となった場合。
(3) 南九州市が、運用上又は技術上やむを得ず本サイトの運営一時中断が必要であると判断した場合。
(4)本サイトの障害等により、本サイトの運営ができなくなった場合。
３．南九州市は、南九州市の裁量によって、本サイトの運営を終了することができるものとします。

＜土砂災害に関する情報＞
１　土砂災害警戒区域（イエローゾーン）及び土砂災害特別警戒区域（レッドゾーン）は、土砂災害警戒区域等における土砂災害防止対策の推進に関する法律に基づき、がけ地の崩壊や土石流が発生した場合に住民に危害が生じる恐れのある区域として鹿児島県が指定した区域です。
２　山地災害危険地区は、山地から発生する山腹の崩壊、崩壊土砂の流出などにより、官公署・学校・病院・道路等の公共施設や人家等に直接被害を与えるおそれがある地区について、鹿児島県が行った調査結果をもとに示しています。

＜洪水に関する情報＞
　浸水想定区域は、万之瀬川水系の洪水予報区間について水防法の規定により指定された想定し得る最大規模の降雨による洪水浸水想定区域、浸水した場合に想定される水深を表示したものです。指定時点の万之瀬川の河道及び洪水調整施設の整備状況を勘案して想定し得る最大規模の降雨に伴う洪水により万之瀬川が氾濫した場合の浸水の状況をシミュレーションにより予測したものです。
　なお、このシミュレーションの実施にあたっては、支流の決壊による氾濫、シミュレーションの前提となる降雨を超える規模の降雨による氾濫、高潮及び内水による氾濫を考慮していませんので、この洪水浸水想定区域に指定されていない区域においても洪水が発生する場合や、想定される水深が実際の浸水深と異なる場合があります。

＜津波に関する情報＞
　Ｌ２津波浸水想定区域は、平成25年3月に危機管理局が公表した鹿児島県地震等災害被害予測調査の津波浸水想定図に基づいています。
　Ｌ２津波浸水想定区域は、国が公表した南海トラフの巨大地震想定のうち、鹿児島県への影響が大きい２つのケースに、鹿児島県独自の検討を加えたもので、現時点において考え得る最大クラスの津波です。
　Ｌ２津波浸水想定区域は、最大クラスの津波が悪条件下において発生した場合に浸水が予想される浸水域と、浸水域内における各地点の最大の水深である浸水深を示したものであり、浸水域や浸水深は、津波の第１派ではなく、第２派以降に最大となる場所もあります。

＜ため池に関する情報＞
　ため池に関する情報は、南九州市が作成したため池ハザードマップの情報をもとに、万が一ため池が決壊した場合どこまで浸水区域が広がるかを想定し示したものです。実際の災害時には、想定を上回る可能性があることに留意してください。

＜利用条件＞
